These terms set out the conditions on which Delta Strike makes this website, its content, and its enquiry forms available to you.

By accessing or using the Delta Strike website (the "Site"), submitting an enquiry, requesting a brochure, or otherwise interacting with us through this Site, you agree to be bound by these Terms of Service and by our Privacy Policy. If you do not agree, please do not use the Site.

2. About Delta Strike

The Site is operated by Delta Strike and is used to showcase our laser tag products and services, including phasers and vests, arena targets, remote control systems, redemption and membership software, business management software, and arena design and installation services. The Site is intended primarily for business operators, prospective franchisees, distributors, and partners interested in our products.

3. Use of the Website

You may browse and use the Site for your own personal or internal business purposes. You agree not to use the Site in any way that is unlawful, that infringes the rights of others, that interferes with the operation of the Site, or that attempts to gain unauthorised access to any part of the Site or its underlying systems. You must not submit false, misleading, or third-party personal information through any of our forms.

4. Intellectual Property

All content on the Site, including text, graphics, logos, product images, videos, brochures, software interfaces, product names, and the "Delta Strike" name and brand, is owned by Delta Strike or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, republish, modify, distribute, or use this content for commercial purposes without our prior written permission, except that you may download brochures and similar materials we make available for the purpose of evaluating our products.

5. Forms, Enquiries, and Marketing Communications

When you submit any form on the Site - including brochure requests, contact forms, demo requests, partner enquiries, and any other lead capture form - you acknowledge and agree that the information you provide (such as your name, business name, email address, phone number, country, and any free-text comments) will be collected, stored, and processed by Delta Strike and our service providers (including, but not limited to, our customer relationship management platform).

In addition to using your information to respond to your specific request, you agree that Delta Strike may use the information you submit through any form on the Site for marketing purposes. This includes, without limitation:

  • sending you product updates, newsletters, brochures, sales materials, event invitations, and other promotional communications about Delta Strike products and services;
  • following up by email, phone, or messaging platform with sales and account information relevant to your enquiry;
  • segmenting and analysing form submissions to improve our marketing, our products, and the relevance of communications we send you;
  • building audiences and lookalike audiences on third-party advertising platforms based on hashed contact details, where permitted by law; and

You can opt out of marketing communications at any time by using the unsubscribe link in any marketing email we send you, or by contacting us using the details in section 11. Opting out of marketing does not affect transactional communications relating to an active enquiry, quote, order, or support case.

Product specifications, photography, renders, dimensions, configuration options, lead times, and any prices shown on the Site are provided for general information only. They are indicative and may change without notice. Nothing on the Site constitutes a binding offer, quotation, or contract for sale. A binding agreement is only formed once Delta Strike issues, and the customer accepts, a written quotation or order confirmation for specific products and services.

To the fullest extent permitted by law, Delta Strike, its directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your access to or use of the Site, any reliance placed on its content, or any inability to access the Site, even if Delta Strike has been advised of the possibility of such damages.

Delta Strike does not control, endorse, or assume responsibility for the content, privacy practices, or terms of any third-party sites or services, and your use of them is at your own risk.

These Terms of Service are governed by the laws of New Zealand. Any dispute arising out of or in connection with these terms or your use of the Site is subject to the exclusive jurisdiction of the courts of New Zealand.
